Chichester Board of Selectmen
SELECTMEN’S MINUTES  
June 28, 2005

Present:  Chairman DeBold, Selectman Colbert, Selectman MacCleery and Patty Wooster, Administrative Assistant.  Chairman DeBold opened the meeting at 7:00PM.

SUBJECT: Building Inspector

HIGHLIGHTS:  The Building Inspector, Mr. Dave Paveglio asked the Board if Dr. Kevin Mara could place an antique barn of his property without getting a site review from the Planning Board.  Mr. Paveglio stated that Dr. Mara had the opportunity to purchase an antique barn and he would like to put it on his property for storage only.  Mr. Paveglio stated that Dr. Mara had plenty of property.  The Board of Selectmen did not see this as a problem and they did not believe that Dr. Mara has to go the Planning Board so long as the building/barn was not used for his business.  Mr. Paveglio stated that he would contact Dr. Mara and advise him that he can put the barn on his property.

Mr. Paveglio stated that he received a call from Super Shoes regarding a special license for a Family Fun Day on August 28.  Mr. Paveglio stated that he was not aware of any special license or permit, but advised Super Shoes to contact Police Chief Patrick Clarke to see if the police department had any specific requirements.

Selectman MacCleery asked the Police Chief if he knew about the “ice cream” man.  Chief Clarke said he had some documentation on the person.  The “ice cream” man came to Town Hall to see about a permit or license to sell ice cream.  Evelyn Pike, the Town Clerk told him he did not need a peddlers/hawkers’ license.  Chief Clarke and Mr. Paveglio stated they thought that the Town of Chichester should have in their ordinance a requirement for a peddlers/ hawkers’ license. Chairman DeBold asked Mr. Paveglio to check with surrounding towns to see what, if any, ordinance or regulation they may have to license traveling vendors or salesmen.

SUBJECT:         Fire Department

HIGHLIGHTS:  Fire Chief, Mike Paveglio asked the Road Agent, Mr. David Kenneally if Blackman Road could be safely accessed for mutual aide calls.  He said that he noticed  the bridge was posted for 6 tons.  Mr. Kenneally stated that weight limits do not pertain to emergency vehicles.  He stated that the bridge was posted by the Selectmen.  Mr. Kenneally stated that the taxpayers do not want to pay for damages to the bridge that would be caused by daily trucking.

Chief Paveglio stated that the GMC K-1 tanker is not reliable enough for the fire department and asked if the road agent could use the truck.  Mr. Kenneally stated that he would be able to use the tanker.  Chief Paveglio cautioned him on the maintenance of the tanker, he said that in the winter it would be wise to keep the tanker full of water and environmentally safe antifreeze.  Chief Paveglio stated that the expansion parts need to be cleaned.

Selectmen Colbert asked Chief Paveglio about the pick-up truck on loan to Chichester from Bow.  He wanted to know if the Town purchased this vehicle would that mean the Town would have two forestry vehicles.  Chief Paveglio answered in the affirmative.  Selectmen Colbert asked Chief Paveglio what would be the difference between the two vehicles and Chief Paveglio said there would be no difference.  Selectman Colbert asked Chief Paveglio when the last payment would be made on the big truck, the answer was 2008. Chief Paveglio stated that there would be a need to replace two engines.  He also stated that the fire department needs a tank truck that holds between 1,500 and 2,000 gallons of water.  Chief Paveglio stated that he would use the impact fees to purchase the tank truck.

Chief Paveglio stated that he had submitted the application for the full-time firefighter/EMT grant.  He said he should hear something in November.

SUBJECT: Emergency Management

HIGHLIGHTS:  Mr. John Martel shared with the Board the response he received from FEMA regarding a letter that was sent to the Selectmen’s office a few weeks ago.  In that letter it stated that the Town of Chichester lost the opportunity to secure a grant from Homeland Security.  Mr. Martel told the Board that someone from the Budget Committee had contacted FEMA to receive information about grants.  He said that FEMA will give the Town one week to decide if we want the grant.  There was no guarantee that the Town will be given the grant.  Chief Clarke said he would like to look into the process to see if the Town qualified for the grant.

SUBJECT: Police Department

HIGHLIGHTS:  Chief Patrick Clarke shared with the Board information regarding a traffic counter and speed tracker.  He said that the Towns of Pittsfield and Epsom will share the device with Chichester. The cost to each town is $2,500.00.  Pittsfield had received a grant to make this purchase.  He said that Epsom will store the device and Pittsfield will cover the maintenance.

Chief Clarke said he has not received the test results for potential police officers from New Hampshire Technical Institute.  Chief Clarke said that he is going to host his own written test.  He said that he has received 15 applications for the open police positions.  He said that only two applicants were certified and they were from out of state.

SUBJECT: Highway Department

HIGHLIGHTS:  The Road Agent, Mr. David Kenneally said that he has swept off the bridges.  Selectman Colbert stated he noticed there was still a lot of sand and salt around bridge columns.  Mr. Kenneally stated that if he received the tank truck from the Fire Department he would then be able to get the rest of the sand and salt off the bridge and blow out the culverts.  

Mr. Kenneally stated that he had a small mishap with the grader.  He said that the blade fell off.  He said he had to replace large bolts and was able to re-attach the blade.  

Mr. Kenneally stated that he had received one bid for roadside mowing.  He said the bid was too high.  He also stated that he was trying to get in touch with the company that did it last year to see if they would be interested in doing it this year.  He said he has received two bids for tarring.   

Selectman MacCleery stated that he had received a call from the Love’s regarding a culvert on Horse Corner Road.  The Love’s wanted to know the size of the pipe that should be used in culvert.  

Selectman MacCleery told Mr. Kenneally that the guardrails on Kelley’s Corner Bridge at the end of Pleasant Street needs repairs.  Mr. Kenneally said that he would take a look at the guardrails.

Selectman MacCleery asked Mr. Kenneally if he put bids out for the winter sand.  He said he had and that he was going with the company that he used last year.

Also brought to the attention of Mr. Kenneally was tree limbs on Canterbury Road that seem to be hanging down too close to the road.  Mr. Paul Sanborn stated that this was a safety issue and should be taken care of as soon as possible.  Mr. Kenneally said he thought that the State owned that portion of the road and it would be the State’s responsibility to have the limbs cut.  Chairman DeBold stated that he would take a look at the trees and contact the State.

SUBJECT: General Business

HIGHLIGHTS:  Selectman MacCleery asked Chairman DeBold whom he had to speak to get the roof of the dugout repaired at Carpenter Park.  He said the shingles needed to be completed.  Chairman DeBold stated that he would be the person to speak to and he said that he was going to have his son paint the dugout as a community project.  Chairman DeBold stated that he would personally take care of the shingles on the dug out.

The Selectmen reviewed a letter from Ms. Pamela Stiles who submitted her resignation from the Trustees of Trust Funds.  The Selectmen have not accepted Ms. Stiles resignation at this time as they want an opportunity to discuss the situation with her.

The Selectmen reviewed a letter from the Town Attorney, Matt Serge regarding the subdivision in Epsom.  Chairman DeBold asked Patty to send a memo to the Planning Board regarding Attorney Serge’s letter and the position of the Board of Selectmen that the applicant of the Epsom subdivision, once receiving approval from the Chichester Police Department would need to petition the Board of Selectmen under RSA 647:40a for approval to alter Hillview Drive and possibly other Chichester Town roads. Also reviewed was a Verified Petition for Declaratory Judgment and Permanent Injunctive Relief and Assessment of Civil Fines and Attorney Fees.  This documentation will be served upon the Weathervane for the non-compliance of the lighting ordinance.

Mr. Gil Vien who is a member of the Trustees of Trust asked Patty to research how many signatures are required on a check and who had signing privileges on the accounts kept at TD Bank.  Patty called TD Bank in Epsom and was advised that all three members of the Trustee of Trust Funds had signature cards on file.  Terry Knowles, from the Attorney General’s Office, advised Patty that two signatures are required on all trustee of trust funds documents to make it legal.  

The Board signed payroll and accounts payable.  

Legal correspondence, mail and e-mail were reviewed.  

Minutes from June 21, 2005 were reviewed and signed

Being no further business, Chairman DeBold adjourned the meeting at 11:00pm.
